Acceptance of These Terms

By creating an account, accessing ApolloTrail, using the Service, starting a subscription, or otherwise using any ApolloTrail feature, you agree to these Terms.

If you do not agree to these Terms, do not use ApolloTrail.

These Terms apply together with our Privacy Policy and Cookie Policy. If you use paid features, Stripe or another payment provider may also apply its own terms and policies to the payment process.

The Service

ApolloTrail is an AI-powered gaming assistant. The Service may provide gameplay support, explanations of game mechanics, strategic suggestions, contextual answers, live web search features, conversation history, account settings, usage limits, and paid subscription features.

ApolloTrail is provided as a cloud-based software service through supported browsers and internet-connected devices. Some features require an account. Some features require an active paid subscription.

Feature availability, usage limits, supported games, model behavior, response quality, search availability, and plan benefits may vary by plan, account status, location, device, technical availability, and operational needs.

Eligibility

You may use ApolloTrail only if you can legally enter into a binding agreement or have any required permission from a parent or legal guardian.

ApolloTrail is not directed to children under 13 years old. Children under 13 may not create an account or use the Service.

If you are at least 13 but under the age of majority in your country or state, you may use ApolloTrail only with permission from a parent or legal guardian where required by applicable law.

You may not use ApolloTrail if you are located in a country, region, or territory where use of the Service is prohibited by applicable law, sanctions, export-control rules, or restrictions that apply to ApolloTrail or its service providers.

Accounts

You must provide accurate and complete account information and keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at [email protected] if you believe your account, credentials, or Personal Data have been compromised.

ApolloTrail may refuse registration, suspend access, limit features, or terminate accounts where we reasonably believe this is necessary to protect the Service, users, third parties, legal compliance, payment integrity, or our rights.

You may request account deletion through the tools provided in the Service or by contacting [email protected]. Data handling after deletion is described in the Privacy Policy.

AI Output

ApolloTrail uses artificial intelligence technologies to generate gaming assistance, recommendations, explanations, and contextual responses.

AI-generated output may be inaccurate, incomplete, outdated, unavailable, offensive, or unsuitable for your situation. ApolloTrail does not guarantee that AI output is correct, complete, current, safe, or appropriate.

The Service is provided for informational and entertainment purposes. You are responsible for evaluating and verifying AI output before relying on it.

ApolloTrail does not provide professional advice, legal advice, financial advice, medical advice, safety advice, or other regulated advice. Do not use ApolloTrail for decisions that may affect legal rights, employment, credit, housing, insurance, healthcare, safety, or similarly significant matters.

Do not submit sensitive Personal Data, confidential information, payment card numbers, government identification numbers, health information, information about children, or other high-risk information in prompts or chat messages.

User Content and Prompts

You may submit prompts, messages, questions, feedback, and other content through the Service. You are responsible for content you submit and must have the rights needed to submit it.

You keep ownership of your content. By submitting content to ApolloTrail, you grant ApolloTrail a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, adapt, and use that content as reasonably necessary to provide, operate, maintain, secure, troubleshoot, support, enforce, and improve the Service.

Your prompts, chat history, AI outputs, and related metadata may be processed by ApolloTrail and by service providers that help provide the Service, including AI infrastructure providers, hosting and backend providers, authentication providers, payment providers, analytics providers where enabled with any required consent, logging and security providers, support providers, and email providers. Details are provided in the Privacy Policy.

Unless we clearly state otherwise, prompts submitted through ApolloTrail are not used to train third-party foundation models. ApolloTrail may use prompts, outputs, usage patterns, and diagnostics to maintain, secure, debug, evaluate, and improve the Service where permitted by law and subject to appropriate safeguards.

We may review user content and AI interactions when reasonably necessary to investigate abuse, troubleshoot technical issues, provide support, enforce these Terms, improve safety, comply with law, or protect ApolloTrail, users, and third parties.

Acceptable Use

You may use ApolloTrail only for lawful purposes and in accordance with these Terms.

You must not:

  • violate any law, regulation, third-party right, platform rule, or these Terms;
  • submit content that is unlawful, infringing, defamatory, abusive, harassing, hateful, pornographic, exploitative, violent, deceptive, or otherwise harmful;
  • submit child sexual abuse material or content that facilitates exploitation or abuse of children;
  • impersonate another person or misrepresent your identity, affiliation, account status, or authority;
  • attempt to access another user's account or collect another user's Personal Data without authorization;
  • probe, scan, test, bypass, disable, or interfere with security or authentication measures;
  • introduce malware, malicious code, automated abuse, scraping, credential stuffing, denial-of-service activity, or similar harmful activity;
  • reverse engineer, decompile, extract, copy, resell, sublicense, or commercially exploit the Service except where applicable law expressly allows it;
  • use the Service to build, train, benchmark, or improve a competing product without our prior written permission;
  • use the Service to generate or distribute spam, phishing, scams, malware, exploit instructions, or unlawful content;
  • use the Service in a way that creates excessive load, disrupts the Service, or degrades other users' experience;
  • evade usage limits, payment obligations, account restrictions, suspensions, or technical controls;
  • submit prompts or requests intended to obtain prohibited, unsafe, infringing, or abusive outputs.

We may investigate suspected violations and take appropriate action, including warning you, limiting features, suspending or terminating your account, removing content, refusing service, reporting misconduct to competent authorities, and preserving or disclosing information where legally permitted or required.

Plans, Subscriptions, and Payments

ApolloTrail may offer free and paid plans. Paid plans may provide higher usage limits, live web search allowances, priority or expanded features, ad-free access, early access features, or other benefits described at the time of purchase.

Prices, plan features, usage limits, billing intervals, renewal terms, taxes, and other payment details are shown during checkout or in the relevant parts of the Service. We may change plans, prices, or features prospectively where permitted by law.

Payments are processed by Stripe or another payment provider. ApolloTrail does not intentionally collect or store full payment card numbers. The payment provider may require you to accept its own terms and privacy policy.

By starting a paid subscription, you authorize the payment provider to charge the payment method you provide for the selected plan, billing interval, applicable taxes, and other charges disclosed at checkout.

Paid access starts after successful payment or as otherwise stated during checkout. If payment fails, is reversed, is disputed, or cannot be processed, we may suspend, downgrade, or terminate paid access.

Subscription Renewal and Cancellation

Paid subscriptions renew automatically unless canceled before the next renewal date, unless a different rule is shown during checkout or required by law.

You may cancel a paid subscription through the controls provided in the Service, through the billing portal where available, or by contacting [email protected].

Cancellation stops future renewals. Unless the Service states otherwise or applicable law requires otherwise, cancellation does not immediately remove paid access. You will usually keep access to paid features until the end of the then-current billing period.

If you delete your account, cancel payment authorization, or otherwise prevent renewal, paid access may end at the end of the current billing period or earlier where necessary to protect the Service, comply with law, or prevent abuse.

Refunds and Withdrawal Rights

Except where required by applicable law or expressly stated by ApolloTrail, subscription fees are non-refundable and we do not provide partial refunds for unused time, unused credits, unused search allowances, downgrades, account suspension, or cancellation during a billing period.

Nothing in these Terms limits mandatory consumer rights that cannot be waived by contract.

If you are a consumer in the European Union, European Economic Area, United Kingdom, Brazil, or another jurisdiction that grants mandatory cancellation, withdrawal, refund, or conformity rights for digital services, those rights apply to the extent required by law.

Where legally permitted, you may be required to pay for the portion of the Service already provided before withdrawal or cancellation takes effect.

To request a refund or exercise a mandatory withdrawal or cancellation right, contact [email protected] with your account email, purchase details, and a clear statement of your request.

Credits, Usage Limits, and Search

ApolloTrail may use credits, message limits, search allowances, rate limits, fair-use limits, or similar controls. These controls may vary by plan and may change over time.

Credits and usage allowances are not cash, stored value, property, or transferable assets. Unless expressly stated otherwise, unused credits or allowances do not roll over, have no monetary value, and are not refundable.

Live web search and other third-party or network-dependent features may be unavailable, delayed, incomplete, blocked, rate-limited, or inaccurate.

Ads and Marketing

ApolloTrail may include advertisements or sponsored content in the Free plan or other unpaid experiences in the future.

ApolloTrail does not currently use Personal Information for cross-context behavioral advertising or targeted advertising. If that changes, we will update the relevant policies and provide legally required notices and choices.

Marketing emails are optional where consent is required. You may unsubscribe from marketing emails using the unsubscribe method in the email or by contacting [email protected]. We may still send non-marketing messages about your account, security, purchases, legal notices, or service changes.

Third-Party Services and Links

ApolloTrail may rely on third-party services, including AI infrastructure, hosting, backend, authentication, payment, analytics, logging, monitoring, security, email, newsletter, and support providers.

Third-party services may be subject to their own terms, privacy policies, availability limits, technical controls, and legal requirements. ApolloTrail is not responsible for third-party websites, services, content, outages, or decisions except where applicable law says otherwise.

The Service may link to external resources, game-related content, websites, or third-party materials. Links do not mean that ApolloTrail endorses or controls those resources.

Intellectual Property

ApolloTrail, including its software, design, interfaces, branding, text, graphics, logos, product names, features, and other materials, is owned by ApolloTrail or its licensors and is protected by intellectual-property laws.

Except for the limited right to use the Service under these Terms, you do not receive any ownership interest or license in ApolloTrail's intellectual property.

You may not copy, modify, distribute, sell, lease, sublicense, publish, frame, mirror, or create derivative works from ApolloTrail or its content except as expressly allowed by these Terms or applicable law.

Feedback

If you send feedback, suggestions, ideas, bug reports, feature requests, or similar input, you grant ApolloTrail a worldwide, perpetual, irrevocable, royalty-free license to use it without restriction or compensation to you.

Service Availability and Changes

ApolloTrail may be modified, interrupted, limited, suspended, or discontinued in whole or in part at any time, including for maintenance, security, legal, operational, provider, or business reasons.

We do not guarantee that the Service will be available at all times, error-free, secure, uninterrupted, or compatible with every device, browser, operating system, network, or region.

We may add, remove, limit, or change features, models, plans, prices, usage limits, supported games, search functionality, and other parts of the Service. Where legally required, we will provide notice or obtain consent before changes take effect.

Support

Support is provided on a reasonable-efforts basis through the contact methods or in-product tools made available by ApolloTrail.

We do not guarantee any specific response time, resolution time, support channel, feature restoration, or outcome unless expressly stated in a separate written agreement.

Privacy and Cookies

Our Privacy Policy explains how we collect, use, disclose, retain, and protect Personal Data.

Our Cookie Policy explains how ApolloTrail uses cookies, local storage, service workers, analytics technologies, and similar technologies, and how users can manage preferences.

Disclaimers

To the maximum extent permitted by applicable law, ApolloTrail is provided on an "as is" and "as available" basis.

ApolloTrail disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and uninterrupted operation.

ApolloTrail does not warrant that:

  • AI output will be accurate, complete, current, safe, or useful;
  • the Service will meet your requirements or expectations;
  • defects or errors will be corrected;
  • the Service will be available without interruption;
  • the Service will be free of harmful components;
  • third-party services will remain available or operate correctly.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

Limitation of Liability

To the maximum extent permitted by applicable law, ApolloTrail and its owner, affiliates, service providers, licensors, contractors, and personnel will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, revenue, goodwill, data, use, business opportunity, or anticipated savings.

To the maximum extent permitted by applicable law, ApolloTrail's total liability for all claims relating to the Service or these Terms will not exceed the greater of:

  • the amount you paid to ApolloTrail for the Service in the 12 months before the event giving rise to the claim; or
  • EUR 100.

These limitations apply whether the claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory, even if ApolloTrail has been advised of the possibility of damages.

Nothing in these Terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, intentional misconduct, fraud, or mandatory consumer-law rights where applicable.

Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ApolloTrail and its owner, affiliates, service providers, licensors, contractors, and personnel from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:

  • your use or misuse of the Service;
  • content you submit or transmit through the Service;
  • your violation of these Terms;
  • your violation of law or third-party rights;
  • unauthorized activity under your account;
  • your fraud, willful misconduct, or abuse of the Service.

This indemnity does not apply where prohibited by mandatory consumer law.

Termination

You may stop using ApolloTrail at any time. You may delete your account or request deletion as described in the Service and Privacy Policy.

We may suspend, limit, or terminate your access to ApolloTrail if we reasonably believe that:

  • you violated these Terms;
  • your account creates security, legal, payment, operational, or abuse risk;
  • payment fails, is disputed, or is reversed;
  • continued access would expose ApolloTrail, users, or third parties to harm;
  • we are required to do so by law or by a service provider restriction;
  • the Service or a material feature is discontinued.

Termination does not affect obligations that by their nature should continue, including payment obligations, intellectual-property restrictions, disclaimers, liability limits, indemnity, dispute provisions, and rights needed to enforce these Terms.

Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the date above and provide additional notice where required by law. Changes apply from the effective date stated in the updated Terms or notice.

If you continue using ApolloTrail after changes take effect, you accept the updated Terms. If you do not agree to updated Terms, you must stop using the Service and may cancel your account or subscription.

Where legally required, we will ask for your consent before applying changes.

Governing Law and Disputes

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, except where mandatory consumer-protection laws in your country or region require otherwise.

The courts competent for the Owner's location in Poland will have jurisdiction over disputes relating to these Terms or the Service, except where mandatory consumer-protection laws give you the right to bring claims elsewhere or prevent this jurisdiction clause from applying.

Before starting formal proceedings, you agree to contact [email protected] and provide a brief description of the issue, your account email, and the relief you request. We will try to resolve the dispute in good faith. This does not limit any mandatory rights you may have to bring claims, contact regulators, or use legally required complaint mechanisms.

Consumer Rights

Nothing in these Terms excludes, restricts, or modifies rights that cannot be excluded, restricted, or modified under applicable consumer-protection law.

If a provision of these Terms conflicts with a mandatory consumer right that applies to you, the mandatory consumer right controls only to the extent of the conflict.

Assignment

You may not assign or transfer your rights or obligations under these Terms without ApolloTrail's prior written consent.

ApolloTrail may assign, transfer, subcontract, or delegate rights and obligations under these Terms where permitted by law, including in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or service-provider arrangement.

Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in effect. The invalid, illegal, or unenforceable provision will be interpreted or replaced to the extent needed to make it valid and enforceable while preserving its original intent as closely as possible.

No Waiver

ApolloTrail's failure to enforce any provision of these Terms is not a waiver of that provision or any other right.

Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and any purchase terms presented during checkout, form the entire agreement between you and ApolloTrail regarding the Service.
